Buying and selling property can be both exciting and challenging. Often your matter can become just another reference number resulting in your transfer dragging unnecessarily.

A quick guide to the Conveyancing Process

Congratulations, you have found your dream home!!! Here follows a quick explanation on the process that will be followed in order to register your new home in your name.

 

 

STEP 1

 

  • A copy of your Deed of Sale is given to the Conveyancing Attorney of the seller’s choice

  • The Conveyancer conduct a Deed Search to make sure the property is registered in the seller’s name

  • The Conveyancer request the original Title Deed from the registered owners

  • The Conveyancer request rate clearance figures from the Local Municipality along with a valuation certificate.

  • The Conveyancer apply for levy figures from the Body Corporate and Consent from the Home Owners Association (If applicable)

 

STEP 2

 

  • The Conveyancer follows up on fulfilment of the suspensive conditions, eg. Bond approval or sale of purchaser’s property

  • On confirmation of fulfilment the Conveyancer issue cancellation instructions to the seller’s bondholder (if applicable)

  • The Conveyancer collects necessary documents from seller and purchaser in order to draft transfer documents

 

 

STEP 3

  • The seller and purchaser sign the transfer documents

  • The purchaser signs bond documents (if applicable)

  • The purchaser pays the transfer costs

  • Seller pays the rates which includes advance rates in order to obtain Rates Clearance Certificate

  • The Conveyancer applies for the transfer duty receipt, rates clearance certificate and levy clearance certificate (if applicable)

 

 

STEP 4

 

  • Seller provide: Plumbing, Gas, Electrical, Electrical Fence and Beetle Certificate

 

 

STEP 5

 

  • Conveyancer ensures satisfactory guarantees

  • Conveyancer check FICA requirements

 

 

STEP 6

 

  • Upon receipt of all of the above the Conveyancer arrange with linked bond cancellation and bond attorneys for simultaneous lodgement

  • Deeds are lodged at the Deeds office and receive barcode

  • Deeds are examined

  • Examination process takes 7 to 10 working days

  • On 7th or 10th day deeds appear in the Prep Room and are up for registration

  • Conveyancer has 5 working days to finalise everything – register on following day

  • Conveyancer registers deed at 10:00
